Four employees of Xpect Deep Discount stores in Milford, Derby and Cromwell will get more than $16,800 in unpaid overtime wages following a two-year U.S. Department of Labor investigation.
Workers at Xpect Deep Discount stores in Danbury, East Haven and North Haven are not owed overtime pay, Labor Department spokesman Scott Allen said.
"The Wage and Hour Division either receives complaints or conducts regular enforcement inspections on businesses throughout the United States," he said. "They determine that by looking at pay records or conducting interviews with employers."
By not paying the overtime, Xpect parent Marc Glassman Inc. had violated the overtime pay provisions of the Fair Labor Standards Act, which requires employees to be paid one and one-half times their hourly rate for hours in excess of 40 worked in a week, unless the employee is exempt from overtime pay.
According to court documents, two workers at an Xpect Deep Discount store at 840 Post Road in Milford will receive $4,297.65 and $4,547.22 in owed overtime pay. Meanwhile, a worker at a store in Cromwell is to be reimbursed $4683.87, and an employee at a store in Derby will get $3,275.29.
The federal agency's Wage and Hour Division district office in Cleveland last week announced the consent judgment after determining that Cleveland-based Marc Glassman failed to pay $426,504 in overtime wages to 160 employees at the Connecticut locations and 54 Marc's grocery stores in Ohio.
